Felicity Nannies and Teachers – Candidate Terms and Conditions of Registration
These Terms and Conditions of Registration (“Terms”) set out the agreement between you (“Candidate”, “you”, “your”) and Felicity Nannies and Teachers Ltd (“the Agency”, “we”, “us”, “our”) when you register with us for the purpose of seeking employment opportunities. By completing the Candidate Registration Form and/or submitting your details to us, you agree to be bound by these Terms.
1. Purpose of Registration
1.1 The Agency acts solely as an introduction agency. Our role is to connect candidates with potential clients (families, schools, or organisations) seeking childcare or teaching professionals.
1.2 Registration with the Agency does not create an employment relationship between you and the Agency. The Agency does not employ candidates directly.
2. Scope of Services
2.1 These Terms apply to all services provided by the Agency to you as a Candidate.
2.2 The Agency may provide advice, introductions, and assistance in securing interviews or placements, but the final decision to offer or accept employment rests exclusively with the client and the candidate.
2.3 By registering, you authorise the Agency to share your profile and relevant information with prospective clients, subject to data protection laws.
3. Candidate Obligations
3.1 You must provide accurate, complete, and up-to-date information in your registration form, CV and any other documentation requested.
3.2 You must hold and, where required, maintain valid work permits, visas, and any professional qualifications or certifications necessary for the role you are seeking.
3.3 You agree to:
• Supply at least two verifiable professional references.
• Disclose any criminal convictions or cautions that are not “spent” under the Rehabilitation of Offenders Act 1974.
• Undertake a Disclosure and Barring Service (DBS) check (or international equivalent) and provide results to the Agency.
• Inform the Agency immediately of any changes to your circumstances that may affect your suitability for work.
3.4 You must conduct yourself professionally and respectfully in all dealings with the Agency and clients.
3.5 You agree not to contact any client introduced to you by the Agency for employment opportunities without the Agency’s prior written consent.
4. Employment Contracts
4.1 Any contract of employment or engagement is made directly between you and the client. The Agency is not a party to such contracts.
4.2 The terms of employment (including salary, hours, duties, holidays, and notice periods) are to be agreed directly between you and the client.
4.3 You are responsible for ensuring that you comply with all applicable legal and tax obligations, including but not limited to income tax, National Insurance contributions, and any self-employment requirements.
5. Fees
5.1 Registration with the Agency is free for Candidates.
5.2 You must not request or accept payment directly from a client for the purpose of bypassing the Agency.
6. Confidentiality and Data Protection
6.1 All information you provide to the Agency will be treated in accordance with applicable data protection laws and our Privacy Policy.
6.2 You agree to keep confidential any personal information about clients and their families that you receive during the application process or while engaged in employment.
6.3 You must not disclose client information to third parties without the client’s express consent.
7. Termination of Registration
7.1 You may withdraw your registration with the Agency at any time by notifying us in writing.
7.2 The Agency reserves the right to remove you from its register at its sole discretion, including (but not limited to) situations where you:
• Provide false, misleading, or incomplete information.
• Breach these Terms.
• Engage in misconduct or behaviour that may harm the Agency’s reputation.
8. Limitation of Liability
8.1 The Agency shall not be liable for any loss, damage, expense, or claim arising out of your employment or engagement with a client, or any failure by a client to meet their obligations.
8.2 The Agency does not guarantee that it will find you employment or that any placement will be suitable or satisfactory.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Germany. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at the location of the Agency’s registered office, Ferringastr 6, 85774 Munich, Germany.
10. Privacy Policy Summary
The personal information you provide in this application will be processed for the purpose of evaluating your suitability for childcare and household placements. Your data will be stored securely and accessed only by authorised personnel within our agency and through our management and recruitment system, Enginehire. We will share your details with prospective families only when you have been shortlisted for a role or have otherwise given explicit consent. We retain your information only for as long as necessary to provide recruitment services, after which it will be securely deleted in accordance with the General Data Protection Regulation (GDPR) and applicable German data protection laws, including the Bundesdatenschutzgesetz (BDSG).
